  1. Age of consent

If you are under 16, you must inform a parent or guardian about our privacy policy to obtain their agreement to the privacy policy before registering, subscribing or placing an order with us.

We collect your information in the following circumstances:

  • When you register or subscribe for one of our services
  • When you place an order, buy a gift voucher

  • When you write a testimonial about us or give us any other feedback such as blog comments

When you buy a product from Vargas Brothers Fire Pits, or when you use our services (please read point 1.1), we collect the personal information you give us. The information we collect and hold about you may include the following:

Whenever you give us your personal information, we will use it in accordance with applicable privacy laws and for the purposes set out in this policy, on the data entry forms you complete, in any relevant terms and conditions and on pages or emails which link to the data entry forms.


If you use any of our services, register or change your account details, register for or attend one of our events, or contact our Customer Care, we will record your personal details. Your information will be used in the first place to provide the products, services or information you have asked for and to provide you with a personalized shopping experience. We keep the information you provide and may use it for several purposes, including:

  • Credit, debit or other payment card verification and screening

 Saved payment card details will only be shared with our payment partner and not with any other third parties and will only be used to process your order, using our payment partner's systems.

  1. How do we get your consent?

When you provide us with your personal information to purchase a product from us or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only.

If we ask for your personal information to be used in order to send you emails about our store, products and special offers, we will either ask you directly for your consent, or provide you with an ‘opt out’ choice.

  1. Testimonials, social media and customer surveys
  • When you write a testimonial about us, we may use it to improve our services and we may want to publish it online or offline to promote our services and our business. We will ask your permission before we publish your testimonial
  • If you follow us on social media platforms (Facebook or Instagram), information you provide will be subject to these third parties’ privacy policy, as well as this privacy policy. If you wish to submit a comment or feedback on either the social media platforms we use, or on our blog, we may (but are not obliged to) publish your comment online or offline to promote our business and our services. We will collect your name or username which will be displayed next to your comment and e-mail address, which will not be published, but which we may use to contact you in relation to your comment
  • Every now and then, we may ask you for your opinion about our services and our products via customer surveys
  • When we collect information about you, we may use it to ensure that when we send you marketing communications or when you make a purchase on our website, or use our online services, you get the best service we can provide and you do not miss offers and information that might interest you. With your permission, we may send you emails about our store, new products and promotions
  1. How can you withdraw your consent?

When you open a customer’s account with us, we offer you a chance to receive our news and fashion updates which may include the following:

  • Information about the arrival of new products
  • Special offers
  • Contests
  • Events of interest
  • One-off marketing promotions

You have the right to ask us not to use your personal information for marketing. At all times, we will offer you the opportunity to unsubscribe from any service or update to which you have subscribed, if you change your mind. Whenever you receive direct marketing from us, we will tell you how to unsubscribe. Alternatively, you can change your marketing preferences by logging into My Account.   1. Security

Our store is hosted on Shopify Inc., an e-commerce platform provider which allows us to sell our products and services to you. Your data is stored on Shopify’s data storage. They store your data on a secure server behind a firewall. 

We will take reasonable precautions to maintain appropriate safeguards to ensure the security, integrity and privacy of the information you have provided to us and to ensure that it is not inappropriately lost, misused, accessed, disclosed, altered or destroyed. We follow the security procedures that applicable privacy laws require. When you provide us with your debit/credit card information or when you access your account information, the information is encrypted using a Secure Socket Layer technology (SSL) in order to protect it from unauthorized use. Your information is stored with an AES-256 encryption. Although no method of transmission over the internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

  1. Payment

Direct Payment Gateway (credit or debit card).

 When you choose a direct payment gateway to complete your purchase, then Shopify Inc. stores your data. Your data is encrypted through the payment card industry data security standard encryption PCI-DSS. Your purchase transaction data is stored only as long as it is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standard set by PCI-DSS, as managed by the PCI Security Standards Council, which is a joint effort of card providers such as Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure a secure handling of credit card information by our store and its service providers.

When we use your information as described in this policy, this may involve sending your information outside the European Economic Area (EEA). When we do this, we make sure that appropriate steps are taken to protect your personal information and your rights. By providing us with your personal information, you agree that we may transfer, store and process your information outside the EEA.

Third Party Services

In general, the third-party providers used by us (such as PayPal), will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

Certain third-party providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions. Once you leave our store’s website or are redirected to a third-party website or application, you are no longer governed by this privacy policy or our website’s terms of service.

Our online services may contain links to websites that are owned and operated by other organizations. These websites have their own privacy and cookie policies, and we encourage you to read their privacy statements. We do not approve any other websites and we are not responsible for any information, material, products or services that are on or accessible through those websites or for the privacy practices of websites run by other organizations. If you use these other websites, you do so at your own risk.
