TERMS AND CONDITIONS AT VARGAS BROTHERS FIRE PITS

1. This website is operated by Vargas Brothers Fire Pits. Throughout the site the terms “we”, “us”, “our” refer to Vargas Brothers Fire Pits and “you”, “yours” refer to you - the customer. By accessing this website, you agree to these terms and conditions, including additional terms and policies such as privacy and cookies policy, shipping terms, returns and refunds terms.

2. This is an online service which solely provides the sale of fire pits and fire pits accessories for your personal use. We have taken great effort to ensure that the products on our website are presented as accurately as possible.

3. Before you proceed to place an order on this website, please read these terms carefully.

4. To be eligible to purchase items on this website you must:

  • Be the holder of a valid debit/credit card
  • Warrant that the personal information which you are required to provide when you register as a customer is true and accurate in all respects
  • Agree that you must not impersonate any other person or entity or use a false name that you are not authorized to use. By using this site you agree to comply with and be bound by these terms. If we proceed to change these terms at our sole discretion, by using this website you agree to comply with any such change

 

ORDERING FROM VARGAS BROTHERS FIRE PITS

1. When you order an item from Vargas Brothers Fire Pits you are agreeing to buy it for the price stated, subject to our terms and conditions.

2. Select the items you wish to purchase and place them in your shopping basket. Once you have finished selecting the items, review the items in your shopping bag by selecting the “shopping bag” link at the top of the page. You can remove unwanted goods from your shopping bag by using the “remove” and then “update” bag” buttons.

3. Click on “checkout” to complete your order.

4. You will be asked to open a Customer Account by providing your name, email address, date of birth and home address. Once you have opened a customer account we will email you with your username and password. We strongly advise that you keep your username and password confidential. You must inform us if you suspect or discover that your username or password have become known to someone else.

5. In order to check out we will ask you to provide us with your payment details. Once you have provided and confirmed your payment details, you have agreed to purchase the product/s at the prices indicated inclusive of the delivery charges that apply to that/those product/s (please check the DELIVERY section).

You will be sent an email confirmation acknowledging the exact details of your order such as payment reference and the value of your order that will be debited from your credit/debit card or your PayPal account. Please ensure your email details are correct and up to date. Your order will be processed if the item you have chosen is in stock and payment has been approved. If the item is out of stock at the time of ordering we will notify you by email, you will not be charged and your order will be cancelled.

7. For your security, please be aware that first-time orders can only be shipped to the cardholder's billing address or a corporate work address which we are able to verify independently. To avoid delays to your order, please ensure that your billing address matches the address on your card statement, and that the cardholder's name is written as it appears on the card. Please also ensure that your contact details are filled in accurately so that we can contact you if necessary.

8. All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

9. Once we have dispatched your order, we shall contact you on the email address provided in your customer account.

                ACCEPTANCE OF YOUR ORDER


                1. We may not accept your order if:

                • An item you have ordered is out of stock or does not satisfy our quality control standards
                • We are unable to obtain authorization for your payment
                • We identify a product or pricing error

                2. We reserve the right to reject any offer to purchase by you at any time and at our sole discretion. If we are unable to fulfill your order following our order acknowledgment, we will contact you by email and inform you about it. Please see the RETURNS AND REFUNDS POLICY section. 

                3. We may also refuse to process and therefore accept a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of our withdrawing any merchandise from the site whether or not that merchandise has been sold.

 Whilst every effort is made to make sure details on our website are accurate, we may from time to time discover an error in the pricing of products. If we discover an error in the pricing of a product in your order, we will let you know as soon as possible. We shall be under no obligation to accept or fulfil an order for a product that was advertised at an incorrect price and reserve the right to cancel such an order that has been accepted. If you order a product that is priced incorrectly for any reason, we will email you to inform you that we have not accepted your order and/or that the relevant part of your order has been cancelled. If you have already paid for the goods, we shall refund the full amount within 14 days.

                5. If we are unable to supply you with a product, for example because that product is not in stock or because we cannot meet your requested delivery date or because of an error in the price on our site, we will inform you of this by email and we will not process your order for that product. If you have ordered multiple products as part of the same order, which we are able to process, then we will continue to process your order for those products. If you have already paid for the unavailable product, we will refund you the full amount as soon as possible.

                PRICING / PRODUCTS 

                1. All prices are in GBP and are inclusive of VAT at the applicable rate.

                2. All products are subject to availability.

                3. The prices and products displayed on the website are subject to change and we reserve the right to change these at any time and without notice to you provided that if you place an order for products through the website the price you will pay for the product(s) will be the price displayed at the time you place your order except for where the price displayed was incorrect and that pricing error was obvious and unmistakable. The prices displayed on the website at any moment are only valid at that moment.

                 4. The price of a product does not include delivery charges. Our delivery charges are as advised to you during the check-out process. Please see DELIVERY section for more details.

                5. The images of the products on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer’s display of the colours reflects accurately the colour of the products.

                6. PROMOTION CODES 
are non-transferable and there is no cash alternative. Furthermore, they cannot be used in conjunction with any other promotion code or offers, and must be redeemed by the date published, if provided

                PAYMENT

                1. We accept the following payment methods:

                Visa, MasterCard, American Express and Maestro cards and PayPal. You confirm that the credit/debit card that is being used for the payment is yours or that you have been specifically authorized by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to Vargas Brothers Fire Pits we will not be liable for any delay or non-delivery.

                2. Please note that we do not accept postal cheques for orders placed on the website.

                3. We take reasonable care to make our Site secure. All credit/debit card transactions on this site are processed a secure online payment gateway that encrypts your card details in a secure host environment. technology.
 We take reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from vargasbrothersfirepits.co.uk.

                 

                PACKAGING OPTIONS

                1. If you wish to include a gift message, please email it to sales@vargasbrothersfirepits.co.uk stating your order number. When placing your order, check the box under packaging options to include an optional gift message.

                 

                BUYING A GIFT CARD


                • All Vargas Brothers Fire Pits gift cards are issued in UK Sterling Pounds
                • All gift cards are valid for 12 months from the date of purchase
                • You can select the following GIFT CARD options: 25-50-75-100

                HOW TO REDEEM A GIFT CARD

                • Please register for a Vargas Brothers Fire Pits account
                • Sign in, select My Account and under My Gift Cards enter your gift card code. Alternatively, you can redeem on the payment page when making your purchase. Your gift card amount will then be automatically deducted as payment on your next order
                • If your gift card exceeds the total order amount, the remaining balance will automatically be credited to your Vargas Brothers Fire Pits account
                • If your order exceeds the value of the gift card, the remaining balance must be paid by credit or debit card
                • Once you have added a gift card to your account, only you can spend it. The balance will then be valid for 12 months
                1. Gift cards cannot be returned or exchanged for a card /PayPal refund.

                2. We are not responsible if a gift card is lost, stolen, destroyed or used without permission.

                3. Vargas Brothers Fire Pits is not liable for delivery of a virtual gift card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.

                4. Promotion codes cannot be applied to the purchase of a gift card.
